Terms of Service

1. Acceptance of Terms

By accessing or using PHMRS.net, PHMRS Hosting, PowerHouseMix Radio Services, or any related products and services (collectively, “PHMRS Services”), you agree to be bound by these Terms of Service and all applicable Missouri state laws, including but not limited to consumer protection, business registration, and digital communications statutes.

If you do not agree to these Terms, you must discontinue use of PHMRS Services immediately.

2. Services Provided

PHMRS provides digital and technical services including, but not limited to:

  • Website hosting, management, and related server solutions
  • Branding, graphic design, and digital media creation
  • Radio streaming, station management, and broadcast support
  • Technical support and custom digital solutions

Service availability, features, and performance may vary based on your selected plan, subscription, or custom agreement.

3. User Responsibilities

Users of PHMRS Services agree to:

  • Provide accurate and current information during registration and service setup
  • Maintain the confidentiality and security of account credentials
  • Use PHMRS Services only for lawful purposes under Missouri Revised Statutes (RSMo)
  • Refrain from any activity that disrupts, damages, or interferes with PHMRS systems, servers, or other users

Any misuse, abuse, or illegal activity may result in suspension or termination of services at PHMRS’s discretion.

4. Payments & Billing

All services must be paid according to the pricing and billing schedule provided at the time of purchase or in your service agreement.

  • Late or failed payments may result in service interruption or termination.
  • Fees for hosting, design, or radio services are non‑refundable unless otherwise stated in writing.
  • PHMRS reserves the right to update pricing with reasonable notice.
  • All transactions are governed by Missouri consumer protection laws (RSMo Chapter 407).

5. Content Ownership & Usage

You retain ownership of any content you upload, submit, or stream through PHMRS Services, including audio, text, images, and other media.

By using PHMRS platforms, you grant PHMRS a limited license to store, display, transmit, and process your content as necessary to deliver and maintain the services.

Users are solely responsible for ensuring they have the legal rights to all content they publish, in accordance with Missouri copyright and intellectual property laws. PHMRS is not liable for user‑uploaded copyrighted, infringing, or illegal content.

6. Intellectual Property

All PHMRS branding, logos, designs, software, layouts, and proprietary materials are the exclusive property of PHMRS and are protected under Missouri and federal intellectual property laws.

Unauthorized use, reproduction, modification, or distribution of PHMRS intellectual property is strictly prohibited and may result in legal action.

7. Service Availability & Technical Issues

PHMRS strives to maintain reliable uptime, performance, and security for all hosted and streaming services. However:

  • Occasional downtime may occur due to maintenance, upgrades, or unforeseen technical issues.
  • PHMRS is not liable for data loss, service interruptions, or technical failures beyond reasonable control.
  • Users are strongly encouraged to maintain independent backups of their own content.
  • PHMRS complies with applicable Missouri regulations regarding digital service disclosures and consumer rights.

8. Termination of Services

PHMRS may suspend or terminate accounts or services for reasons including, but not limited to:

  • Violation of these Terms of Service
  • Non‑payment or repeated late payment
  • Harmful, abusive, or illegal activity
  • Abuse of PHMRS systems, staff, or other users

Users may cancel services at any time; however, cancellation does not guarantee refunds unless explicitly stated in a written agreement.

Termination and enforcement actions follow Missouri contract law principles regarding service agreements and breach.

9. Privacy & Data Handling

PHMRS respects user privacy and handles personal information in accordance with applicable laws.

  • Personal information is used only for service delivery, billing, security, and customer support.
  • PHMRS does not sell or share user data with third parties except when required by law or with your consent.
  • Data handling complies with Missouri privacy and consumer protection laws (RSMo Chapter 407).

10. Limitation of Liability

To the fullest extent permitted under Missouri law, PHMRS is not responsible for:

  • Loss of revenue, data, or business opportunities
  • Damages resulting from user actions, misconfigurations, or third‑party failures
  • Issues caused by external platforms, plugins, integrations, or third‑party services

In any case, PHMRS’s total liability for claims arising from or related to PHMRS Services is limited to the amount paid by you for the services during the thirty (30) days preceding the event giving rise to the claim.

11. Compliance With Missouri Law

PHMRS operates in accordance with relevant Missouri statutes, including but not limited to:

  • RSMo Chapter 407 – Merchandising Practices / Consumer Protection
  • RSMo Chapter 417 – Business Names, Trademarks, and Fictitious Names
  • RSMo Chapters 351 & 355 – Business Entities and Corporate Regulations
  • Missouri contract law governing service agreements and enforcement
  • Missouri digital communications and electronic transaction laws

Users agree that any disputes arising from or relating to PHMRS Services will be governed by the laws of the State of Missouri and handled under Missouri jurisdiction. Venue for any legal action shall be in the appropriate state or federal courts located in Missouri.

12. Changes to Terms

PHMRS may update or modify these Terms of Service at any time. When changes are made, PHMRS will update the Effective Date at the top of this page and may provide additional notice where appropriate.

Continued use of PHMRS Services after any changes to these Terms constitutes your acceptance of the updated Terms.
